This information channel is the result of the collaboration between our “Oil & Gas” and “Energy” teams.

The newsletter was designed within the context of the energy transition that is being targeted in Brazil, and drafted as a complete source of information about the dynamic Brazilian energy market within the oil, natural gas, electricity and renewable energy sectors.

HIGHLIGHTS

Brazil sets record for oil and natural gas production in June

On August 01, 2023, the Brazilian National Agency for Petroleum, Natural Gas and Biofuels (“ANP”) released the Monthly Oil & Gas Newsletter for June 2023, which gathers data from the national production. During the month of June, 4.324 million barrels of oil equivalent per day (MMboe/d) were produced altogether, of which 3.367 million barrels of oil per day (MMbbl/d) and 152.258 million cubic meters of natural gas per day (MMm³/d). As reported by the ANP, this was the greatest production ever recorded, exceeding that of February 2023, when 4.183 million boe/d were produced.

Regarding oil production, there was an increase of 5.2% in comparison with the previous month, and of 19% in comparison with the month of June 2022, which represents the largest volume of oil production ever recorded. In turn, natural gas production increased 5.4% in comparison with May 2023, and 14.6% in comparison with the month of June 2022, also representing the greatest volume ever recorded, exceeding that of October 2022, when 149 Mmm³/d were produced.

Natural gas: ANP will hold public contribution and hearing on matters relating to gas pipeline transportation services

On August 03, 2023, the ANP’s Board approved the holding of public contribution and hearing in order to streamline both the offering and contracting capacity processes in existing gas pipelines, as well as the public call process to estimate the demand and hire the corresponding capacity in gas pipelines to be built or expanded.   

The draft proposal amended specific provisions of ANP Resolutions No. 11/2016 and No. 51/2013, which regulate, respectively, the offering and contracting processes of transport capacity as well as natural gas loading. According to the ANP, the objective is to increase its effectiveness and agility, thus simplifying the two processes under discussion as a means to mirror the real market conditions. In addition, the amendment also aims at bringing the ANP regulation into line with Law No. 14,134, of April 08, 2021 (New Gas Law) – which gave new meaning to the concept of a public call, among other provisions –, as well as with the guidelines of the Brazilian National Council for Energy Policy (“CNPE”) No. 3/2022.

Open Acreage: ANP opens new cycles in sharing and concession systems

On August 17, 2023, the ANP published the schedules of the 4th Cycle of the Concession Open Acreage (“OPC”) and the 2nd cycle of the Production Sharing Open Acreage (“OPP”).

The public offering sessions for both cycles of the open acreage under discussion are scheduled to take place on December 13, 2023.

Regarding the 4th Cycle of the OPC, registered companies will be able to submit new statements of interest regarding the sectors addressed in the notice until September 28, 2023, along with their offer guarantees. The block sectors offered in the 4th Cycle of the OPC will be published on October 16, 2023. After publication, registered bidders will be able to submit new statements of interest until October 16, 2023, together with their corresponding offer guarantees.

Regarding the 2nd Cycle of the OPP, registered companies interested in participating in the OPP will be able to submit a statement of interest regarding the areas offered until September 28, 2023, along with their offer guarantees and eligibility documents. Publication of the blocks offered will take place on October 16, 2023, so that registered bidders will be able to submit new statements of interest until November 08, 2023, along with their offer guarantees.

ANP debates revision of regulations for quality control of imported fuels

On August 21, 2023, the ANP held a public hearing aimed at discussing the revision of ANP Resolution No. 680/2017, which establishes the obligations for quality control regulations of imported fuels, to be complied with by importers and quality inspection companies accredited by the ANP, across Brazil. According to the ANP, the amendments seek to adapt the resolution under discussion to the new market reality, without prejudice to consumers with regard to the quality of imported fuels.

The key objectives encompassed by the proposed revision of ANP Resolution No. 680/2017 are as follows:

  • Expansion of products regulated by the import quality control regulation, including asphalts, which are added to the current scope: biodiesel, ethanol, liquefied petroleum gas (LPG), automotive gasoline, aviation gasoline, diesel, fuel oil, aviation kerosene (“QAV”), alternative aviation kerosene and green diesel.
  • Establishment of quality control regulations for products imported by land, given the lack of laboratory infrastructure at dry borders.
  • Alignment of regulations included in ANP Resolutions No. 680/ 2017 and No. 859/ 2021, which establish the requirements for accreditation of quality inspection companies in charge of controlling imported products.

Prior to publication, the consolidated text will be subject to legal analysis by the Brazilian Office of the Attorney General (“PGF”), and will also seek the approval of ANP’s Collegiate Board.

ANP debates decommissioning guarantees at workshop

On August 14, 2023, the ANP held the “Decommissioning Guarantees Workshop”, aimed at clarifying the minimum criteria of acceptability as well as the procedures for providing financial guarantees as a means to ensure the decommissioning of production facilities in oil and natural gas fields (such as platforms).

ANP Resolution No. 854/2021, which regulates the decommissioning guarantees, established a transition period until October 02, 2023, for adaptation of the market. To this effect, all production fields in Brazil will need to deliver these guarantees by the date mentioned. The fields involved in contract assignments are the only exception, given that they had to submit such guarantee upon the assignment, even if during the transitional period.

ANP updates regulatory agenda

On August 21, 2023, ANP’s 2022-2023 Regulatory Agenda had its third half-yearly update approved during a board meeting held on August 17, 2023. As reported by the ANP, 54% of the intended plans were accomplished, which is composed of 83 regulatory measures, divided into 5 main themes:

1) Exploration and production

2) Handling of oil, derivatives, natural gas and biofuels

3) Production of oil, natural gas and biofuels derivatives

4) Supply, inspection of supply and quality of products

5) Cross-cutting topics

Regulatory measures encompass new matters and the revision of existing regulations.

ANP debates new guarantee insurance model for decommissioning at public hearing

On August 22, 2023, the ANP held a public hearing to discuss the revision of the guarantee insurance model used in decommissioning operations of oil and natural gas exploration and production facilities, given the need to adapt to the new regulation of the Superintendence of Private Insurance (“SUSEP”) on the topic.

The change in the guarantee insurance model was approved on June 07, 2023, by the ANP’s Board and published in ANP Resolution No. 925/2023. The urgency as regards such publication, before the opening of the public contributions, was necessary because, after the entry into force of SUSEP Circular Letter No. 662/2022, issuing guarantee insurances was no longer possible, as previously stated in ANP Resolution No. 854/2021.

Through the amendment published, the deadline for companies to submit financial guarantees as a means to ensure decommissioning was extended for 90 days, from June 30, 2023, to October 02, 2023. In turn, insurers can already issue new insurance policies in full compliance with the latest SUSEP regulations.

The suggestions received during such contribution and hearing will be assessed by the ANP’s Technical Area. Prior to publication, the consolidated text will undergo the PGF’s and the ANP’s legal analysis, also upon the approval of the ANP’s Collegiate Board.

ANP approves Bylaws of the Users’ Council Representative of Carriers

On August 31, 2023, the ANP’s Board of Directors approved the Bylaws of the Users’ Council Representative of Natural Gas Carriers (Conselho de Usuários Representante dos Carregadores de Gás Natural). The purpose of the Users’ Council is to monitor the performance, operational efficiency, and investments of natural gas carriers. To this effect, as described in its bylaws, it will seek to know, monitor, contribute, make announcements, and inform the ANP about the various topics associated with the natural gas transport activity.

The Users’ Council was created by the new Gas Law (Law No. 14,134/2021), which established that it would be up to natural gas carries to constitute this council, assigning the role of approving its governance structure to the ANP.

Special committee created to analyze Bill No. 414/2021

On August 09, 2023, the chairman of the House of Representatives, Arthur Lira, authorized the creation of a special committee to analyze Bill No. 414/2021, which aims to improve the regulatory and commercial model of the power sector.

Simultaneously, in order to address important matters within the sector, there have been discussions regarding either a new bill or amendments to Bill No. 414/2021.

New Growth Acceleration Program includes investments in the energy sector

On August 11, 2023, the Brazilian Federal Government announced a new version of the Growth Acceleration Program (“PAC”), which provides for investments in infrastructure sectors. With the program, there is an estimate of BRL 540 billion in investments aimed at the energy sector, particularly in transition and energy security programs. Among the PAC’s sub-axis, we highlight:

Schedule for energy transmission auctions released

On August 21, 2023, the Ministry of Mines and Energy (“MME”) published Normative Ordinance No. 67/GM/MME/2023, which established a schedule for auctions involving concessions of public energy transmission services. The auction dates will be published by December 31, 2023.

Authorization of the bids will be subject to the execution of a Transmission System Use Agreement (“CUST”) involving Basic Network facilities whose power transformers’ primary voltage amounts to 230 kV or higher; secondary and tertiary voltages amount to less than 230 kV; and whose connection and equipment are connected to the tertiary voltage, within the following deadlines:

ONS submits technical document explaining “blackout”

On August 15, 2023, the electricity supply of more than 22,000 MW was interrupted across 25 states of Brazil and in the Federal District, initiating with the shutdown of the Quixadá – Fortaleza II transmission line.

The Brazilian Electric System Operator (“ONS”) submitted a document containing technical data regarding the blackout. The detailed assessment of the event will be published through a Disturbance Analysis Report, including information on the root cause of the issue and the sequence of events, as well as recommendations and necessary measures.

ANEEL approves bid notice of the second transmission lines auction

On August 01, 2023, the Brazilian National Electricity Regulatory Agency (“ANEEL”) approved the bid notice regarding the second auction of transmission lines. The auction will involve 3 lots of transmission facilities, totaling 4,471 km of transmission lines and 9,840 MW in transformation capacity of substations, located in the states of Goiás, Maranhão, Minas Gerais, São Paulo and Tocantins. These projects are expected to receive BRL 21.7 billion in investments, and to generate around 36,900 jobs. The auction will be held on December 15, 2023.

ONS receives “Forgiveness Day” applications

Following the publication of ANEEL Normative Resolution No. 1,065/2023, which provides for requirements and procedures relating to the special mechanism for handling generation grants, as well as the CUSTs entered into by generation plants, the ONS published new information about the matter on August 01, 2023.

The ONS reportedly received 351 requests for adhesion to the normative resolution, which amounts to 14.7 GW, in total, of which 11 GW relate to amnesty applications (the possibility of terminating the CUST at a lower cost), and 3.7 GW for regularization (that allows the adjustment of the implementation schedule of the plant). Most of the orders concern solar energy projects, as outlined below:

MME approves service order to connect Roraima to the SIN

On August 04, 2023, the MME approved a service order that will enable the connection of the state of Roraima to the Brazilian National Interconnected System (SIN). According to the MME, “interconnection is expected to reduce the amount of thermal energy generated in the state, thus reducing energy supply costs. The studies regarding the planning of the operation will be updated as the works progress, seeking to balance supply and demand”.

Program “Light for All” reinstated

On August 07, 2023, Decree No. 11,628 was published, which provides for the Brazilian Program for Universalization of Access and Use of Electricity (“Light for All” – in Portuguese, “Luz para Todos”), with the aim of supplying electricity to the rural population residing in remote areas of the Legal Amazon and who does not have access to the energy distribution system.

Among the targets of the program, we highlight: (i) enable and expand access to and use of electricity to the population through the extension of energy distribution networks and isolated generation systems; (ii) reduce social inequality and energy poverty; and (iii) enable energy decarbonization of the Legal Amazon, using clean and renewable energy sources to generate electricity.

Decree modifies CNPE structure and operation

On August 07, 2023, Decree No. 11,629 was published, which amended provisions regarding the structure and operation of the Brazilian National Council for Energy Policy (“CNPE”), an advisory body to the president of Brazil for the development of policies and guidelines aimed at the energy sector. Below, we highlight some of the changes, which provide for energy import:

  • The CNPE has been assigned the role of defining and implementing national policies regarding the integration of energy systems and integration with other countries;
  • The Electric Sector Monitoring Committee (CMSE) became responsible for deciding on electricity import guidelines and conditions; and
  • Insertion of the term “Import Agent” to Decree No. 7,246/2023, as a definition for “agent of the energy sector that imports electricity, upon specific authorization, and is the holder of a concession, permission or authorization for generation or trade”.

ANEEL publishes Measuring Regulatory Performance regarding the calculation of price difference and tariffs

On August 09, 2023, ANEEL published Technical Note No. 68 /2023-SGM/ANEEL, addressing the Measuring Regulatory Performance (or “Avaliação de Resultado Regulatório”, in portuguese) of the regulation relating to the maximum and minimum amounts of Differences Settlement Price (“PLD”) and the Optimization Energy Tariff (“TEO”), which are regulated by REN No. 1032/2022.

The main findings after the assessment under discussion were:

  • Maximum structural PLD: formation and value ensured solvency for the energy market, while addressing the costs of the supply security service;
  • Reconciliation between the maximum structural PLD and the maximum time PLD: system requires improvement, given that the current framework failed to ensure price variability on a daily basis;
  • Minimum PLD: methodology is appropriate, ensuring uniform remuneration to market agents;
  • TEO: its support database is outdated, which requires regulatory attention; and
  • TEO Itaipu cost structure: in compliance with the established definitions of variable cost, and as such, the minimum PLD formation methodology remains eligible.

“Amazon Energy” decree published

On August 17, 2023, Decree No. 11,648 was published, implementing the “Amazon Energy” program (in Portuguese, “Energias da Amazônia“). The program in question aims to: (i) reduce the use of fossil fuels to generate electricity and, consequently, greenhouse gas emissions; (ii) contribute to the quality and safety of the electricity supply; and (iii) reduce expenses pertaining to the fuel consumption account.

HIGHLIGHTS

BNDES expands resources for biofuels to BRL 3.5 billion

On August 01, 2023, the Brazilian National Bank for Economic and Social Development (“BNDES”) approved an increase of BRL 1.5 billion for the RenovaBio program, thus expanding the available resources for the biofuels sector to BRL 3.5 billion. According to the publication, the aim of the measure is to meet the demand of the biofuels sector for Environmental, Social and Governance credits (“ESG credits”) by the end of 2024.

The agreement provides for direct support through ESG credits for the biofuels sector, within the scope of RenovaBio, with an encouragement to improve energy and environmental efficiency, in addition to production certification.

BNDES estimates an improvement in energy and environmental efficiency in the operations already contracted. According to the BNDES, the set of supported plants will be able to produce biofuels capable of avoiding 3.4 million tons of carbon emissions per year, a volume 14% higher than that observed at the contracting of operations.

New PAC targets low-carbon fuels to foster energy transition

On August 11, 2023, the Brazilian Federal Government launched the New Growth Acceleration Program (“New PAC”), with BRL 540,3 billion investments in energy transition and security. This amount will be divided into seven sub-axes, as follows:

  1. Energy Generation
  2. Power for Everyone (“Luz para Todos”) program
  3. Power Transmission
  4. Energy Efficiency
  5. Oil and Gas
  6. Mineral Research
  7. Low-carbon Fuel

The New PAC also recognizes the role of low-carbon fuels in energy transition as well as their potential to reduce impacts on global climate change. According to the news published, the new version of the program estimates BRL 26.1 billion for the sector, most of the investments of which will be distributed from 2023 to 2026 (BRL 20.2 billion). After 2026, the projection is BRL 5.9 billion.

Considering state-owned and private funds, the sector’s resources will be allocated towards promoting 100% sustainable biorefining; co-processing of fossil and renewable fuels; second-generation ethanol; direct capture of CO2; biomethane and studies for energy transition.

In addition, the New PAC also prompts investments in biofuels to further expand the Brazilian national energy matrix, in order to prioritize the bioeconomy and the projects that generate green jobs and technological development on sustainable bases, as well as to leverage new industrialization.

BNDES obtains USD 500 million from China Development Bank for investments in energy and green economy

On August 22, 2023, the BNDES established a strategic partnership with China Development Bank (CBD) by signing a USD 500 million loan agreement during the 15th BRICS (Brazil, Russia, India, China and South Africa) Summit, held in South Africa.

According to BNDES, the resources – which hold a payment deadline of up to three years – will be used as part of the BNDES investment budget for financing operations on lines already made available by the bank to final customers, which includes the foment of bilateral trade between Brazil and China. Investments can be made in several sectors, such as: oil and gas, the ESG agenda, climate change and green development, cutting-edge technology, among others.

Brazil will have more than BRL 200 million in investments for research on low-carbon hydrogen

On August 24, 2023, the 2023-2025 Triennial Work Plan of the National Hydrogen Program (“PNH2”) was launched by the Ministry of Mines and Energy (“MME”). Among the priorities of the plan are the increase of annual research investments by almost 7 times, as well as the development and innovation in low-carbon hydrogen. As a result of the actions proposed in the plan, investments will escalate from BRL 29 million, in 2020, to BRL 200 million annually as of 2025.

As informed by Minister Alexandre Silveira at the time of the release, as coordinator of the PNH2, the MME is also working on defining a national legal and regulatory framework for hydrogen along with the other ministries participating in the program under discussion for further submission to the National Congress.

The publication comprises a total of 65 measures for the next 3 years relating to hydrogen, of which 32 are already in progress. Among the objectives of the plan, we highlight the expansion of access to competitive financing with development banks so as to enable large-scale projects.

Government of Ceará joins Renewable Hydrogen Pact

On August 09, 2023, the Government of Ceará, together with the Brazilian Association of Wind Energy and New Technologies (“ABEEÓLICA”), the Brazilian Biogas Association (“ABIOGÁS”), the Brazilian Association of Photovoltaic Solar Energy (“ABSOLAR”) and the German-Brazilian Chamber of Industry and Commerce (“AHK”), joined the Renewable Hydrogen Pact, aiming to produce, develop and economically enable green hydrogen in Ceará.

Green hydrogen production plant created by COPPE/UFRJ

On August 11, 2023, the Coordination of Engineering Postgraduate and Engineering Research Programs (COPPE/UFRJ) created a pilot plant for the production of green hydrogen from water electrolysis, using only photovoltaic energy.

Compass partners with OrizonVR to produce biomethane

On August 14, 2023, Compass Gás e Energia S.A. published a material fact to its investors regarding the acquisition of shareholding from Biometano Verde Paulínia (“Newco”), a company that is controlled by Orizon Valorização De Resíduos S.A. The partnership is aimed at the development of a biomethane purification plant by Newco, which is expected to produce up to 180 cubic meters per day, using biogas generated in a landfill owned by Orizon, which will be acquired by Compass Comercialização.

Brazilian Association of Hydrogen and Sustainable Fuels created

On August 01, 2023, according to the article published by Brasil Energia, the Brazilian Association of Hydrogen and Sustainable Fuels (“ABHIC”) has been created. According to the publication, the entity seeks to promote the hydrogen and sustainable fuels market, and aims to implement and leverage the market’s conditions regarding the technological and regulatory aspects of such sector, whose investments for Brazil are estimated at BRL 200 billion in the next 20 years, according to McKinsey & Company’s projection.

The entity launched will represent sectoral interests before public authorities, including executive and legislative bodies, regulatory agencies, Brazilian and international companies, and academic institutions. In addition, the ABHIC aims at an intense action towards implementing the key practices of the global market into Brazil.

As reported, the ABHIC will gather companies from all over the country and the entire hydrogen production chain, especially in the energy, transport, oil, steel and chemical segments, among others.

BNDES prepares a plan of at least BRL 50 billion to finance energy transition projects

According to the publication of August 01, 2023, the BNDES is preparing a plan to finance large energy transition projects through subsidies. As informed, the focus will be on green hydrogen projects, offshore wind farms, low-carbon fuels, sustainable aviation fuel, as well as the replacement of public transport fleets by electric buses.

In addition, the means to leverage the fund, linked to the Ministry of the Environment (“MMA”), with the BNDES as a financial agent, are currently under discussion by the BNDES along with the Ministry of Finance (“MF”).  One of the solutions can be the issuance of green bonds in the international market.

House of Representatives will focus on renewable energy in the second half of 2023

As reported by Valor Econômico on August 08, 2023, three topics are on the radar of the House of Representatives for discussion: the regulation of the carbon market and offshore wind farms, as well as a legal framework on green hydrogen.

After approval of the tax reform, the chairman of the House of Representatives, Arthur Lira (PP-AL), defined that the “green agenda” will be treated as a priority until the end of 2023. Green hydrogen already has a special commission in place since May 2023, in order to try and gather the numerous projects filed.

The regulatory framework for offshore wind farms was approved by the Brazilian Senate in 2022, and is currently in analysis by the House of Representatives. According to the reporting officer, Zé Vitor (PL-MG), a decision is still pending as to the focus of the project under discussion – whether it will be concentrated on offshore wind farms or on renewable energy as a whole.

Ordinance on the use of biodiesel published

On August 09, 2023, Interministerial Ordinance MME/MDA No. 2/2023 was published, which provides for the mechanisms to meet the goals of promotion and acquisitions from the Social Biofuel Seal (“SBS”) for Brazil’s North, Northeast and Semi-arid regions.

The SBS, a nomenclature assigned by the Ministry of Agrarian Development and Family Agriculture (“MDA”), is granted for every biodiesel industrial facility that meets the criteria previously specified. The license is given to producers who are committed to the inclusion of family farmers framed in the National Program for Strengthening Family Farming (“PRONAF”).

As published, such measure was part of the work schedule developed by both the MME and the MDA teams, in partnership with the Ministry of Agriculture, Livestock and Food Supply (“MAPA”), in compliance with the provisions established by Resolution CNPE No. 3/2023, which defined the participation goals for the regions mentioned above, within the scope of the SBS, of at least 10% in 2024, 15% in 2025, and 20% as of 2026.

The ministries under discussion emphasize that the increase in the promotion and acquisitions of the SBS for these regions is only the first measure towards restructuring and strengthening this important public policy instrument as regards the National Program for Production and Use of Biodiesel (“PNPB”).

Wind power represents more than 80% of the installed capacity in July 2023

On August 10, 2023, according to news published by Brasil Energia, wind power led the advance in power generation in Brazil in July 2023, representing more than 80% of the expansion of the installed capacity, according to data from the Brazilian National Electricity Regulatory Agency (“ANEEL”). In July 2023, the sector recorded a significant increase of 525.5 MW in the installed capacity, of which 421.2 MW originated from 18 new wind power plants, 7 of which are located in the state of Rio Grande do Norte. In addition, Paraíba also has made progress through the installation of 104.5 MW in 3 wind facilities.

Additionally, 2 photovoltaic solar plants (93.6 MW), 2 thermoelectric plants (10.0 MW) and 2 small hydroelectric plants (0.7 MW) were incorporated. By the end of July 2023, the Brazilian energy matrix had already increased 5,673.9 MW.

The ANEEL also recorded the start of commercial operations of 176 power plants, of which 79 are wind farms (2,713.8 MW), 61 are solar photovoltaic plants (2,295.1 MW), 25 are thermoelectric plants (531.4 MW), 8 are small hydroelectric plants (122.2 MW) and 3 are hydroelectric generating plants (11.4 MW). Altogether, solar and wind power plants account for 88.3% of the installed capacity for the year.

4th Cycle of Concession Open Acreage – OPC (ANP)

Companies registered for the OPC have until September 28, 2023, to send new statements of interest for the sectors offered in the notice, along with their bid guarantees. The block sectors offered in the 4th Cycle of the OPC will be released on October 16, 2023.

The natural gas accumulation area of Japiim and 955 exploratory blocks located in several sedimentary basins are provided for in the OPC public notice.

The public bidding session is scheduled to take place on December 13, 2023.

2nd Cycle of the Open Acreage of Production Sharing – OPP (ANP)

Companies interested in participating in the OPP have until September 28, 2023, to send new statements of interest for the sectors offered in the notice, along with their bid guarantees and eligibility documents.
