In order to keep our clients informed about the current landscape of the main energy and natural resources sectors in Brazil, we have prepared the Energy Newsletter, a monthly bulletin with the main news of the energy market.

This information channel is the result of the collaboration between our “Oil & Gas” and “Energy” teams.

The newsletter was designed within the context of the energy transition that is being targeted in Brazil, and drafted as a complete source of information about the dynamic Brazilian energy market within the oil, natural gas, electricity and renewable energy sectors.

HIGHLIGHTS

Concession Open Acreage: ANP publishes new versions of the tender protocol and concession agreement

On July 04, 2023, the Brazilian National Agency of Petroleum, Natural Gas and Biofuels (“ANP”) published the new versions of the tender protocol and concession agreement for the Concession Open Acreage (“OPC”). The documents include new blocks and an area with marginal accumulations, and provides for the revision and improvement of the regulations, as well as a calculation update regarding the technical and economic parameters of the assets being offered.

Among the changes in the tender protocol, we highlight: (a) implementation of a simplified qualification; (b) extension of the maximum completion time frame from a 90-day cycle to a 120-day cycle; (c) possibility of opening a new cycle immediately after the closure of the public session of an ongoing cycle, without requiring the approval; (d) 955 exploratory blocks subject to offering, including 87 remaining blocks of the 17th Bidding Round and the PRC-T-54 block, as well as ES-T-399 block included once again (which was auctioned in the 3rd cycle, but whose contract had not been executed) and; (e) area subject to offering along with Japiim’s marginal accumulations. According to the ANP, the changes are due to both Public Consultation and Hearing No. 21/2022, as well as Public Hearing No. 5/2023. 

Finally, it is worth highlighting that ANP’s Collegiate Board approved Resolution No. 329/2023, of June 30, 2023, for the exclusion of 143 blocks, whose term of approval by both the Ministry of Mines and Energy (“MME”) and the Ministry of Environment (“MMA”) expired in July 2023.

Open Acreage: ANP publishes dynamic dashboard featuring information on available blocks and areas

On July 17, 2023, the ANP published a dynamic dashboard with information on blocks or areas available in the tender protocols of the Concession Open Acreage and Production Sharing Open Acreage (“OPP”).

The dashboard launched by ANP introduces the total number of available blocks or areas in the current tender protocols and the details the parameters used in the OPC and OPP (for example: minimum bonus, Minimum Exploratory Program (“PEM”), offering guarantee and qualification requirements) for each block or area.

In addition, the panel shows the list of companies registered to participate in any Open Acreage Bid.

Local Content: ANP will carry out public consultation and hearing for resolution on accreditation of certifiers

On July 20, 2023, ANP’s Collegiate Board announced a 45-day public consultation (until September 08, 2023), followed by a public hearing, in order to draft a resolution on the requirements and procedures for the accreditation of local certification bodies of goods and services. As informed by the ANP, the new regulation will repeal the resolution in force on the subject (ANP Resolution No. 869/2022).

The public hearing is scheduled to take place on September 27, 2023, from 10 a.m. to 12 p.m.

Study on local content reports approved

On July 20, 2023, ANP’s Collegiate Board approved the Regulatory Impact Analysis (“RIA”) Report No. 1/2023/SCL/ANP-RJ regarding the amendment to ANP Resolution No. 871/2022. The resolution regulates the Quarterly Expense Report (“RGT”) as well as the Local Content Report (“RCL”).  

According to the RIA Report, which was submitted to public consultation for 60 days, the best alternative for improving the regulations in force is to amend Resolution No. 871/2022. The new draft resolution will be submitted to public consultation and hearing and should include, notably: (a) provision for a production sharing report model; (b) definition of the relationship criteria between reports and contractual commitments; (c) standardization of deadlines and procedures for drafting reports; (d) updated concepts relating to accounting principles and taxes; and (e) details of documents for proof of expenses with national suppliers. 

In addition, Technical Note No. 10/2023/SCL/ANP-RJ was approved, which submits the final position of the ANP in relation to the contributions received in the public consultation.

Oil and gas production in Pre-Salt escalates 5.9% in May

As announced by the ANP on July 04, 2023, the production around the Pre-Salt layer reached 3.196 million barrels of oil equivalent per day (boe/d) in May, thus corresponding to 77.8% of the overall domestic production. According to the ANP, 2.510 million barrels per day (bbl/d) of oil and 109.16 million cubic meters per day (m³/d) of natural gas were produced by 144 wells. Therefore, as compared to the previous month, an increase of 5.9% was recorded, and in comparison with the same month, last year, an increase of 12.7% was registered. The information is available in the Monthly Newsletter of Oil and Natural Gas Production of May 2023, which shows consolidated data regarding the overall domestic production.

In May, a total of 4.110 million barrels of oil equivalent per day (boe/d) was produced within Brazil, of which 3.201 million barrels of oil per day (bbl/d), and 144.410 million cubic meters of natural gas per day (m³/d). As for oil production, the data show a 1.9% increase in comparison with the previous month, and an 11.2% increase if compared to May 2022. As for the natural gas market, the production underwent a 2% increase in relation to April 2023, and a 9.6% increase as compared to May 2022.

Construction of Macaé Port Terminal will begin in 2024

On July 07, 2023, according to an article published on the news channel Petróleo Hoje (free translation: “Oil Today”), by Editora Brasil Energia, the construction of the Macaé Port Terminal (“Tepor”) will begin in the first half of 2024, counting on the expected investment of BRL 5 billion within three years, as reported on July 04, 2023, by the city government of Macaé (in the state of Rio de Janeiro). The terminal will provide logistical support to oil operators with activities in the Campos and Santos basins.

According to Hugo Crespo, head of business development of Grupo Vale Azul (“GVA”), the kick-off of the terminal’s trade operations is scheduled for the end of 2026. GVA is in charge of the Tepor project and, in 2021, entered into an agreement with exclusive and preemptive rights with Eneva for the constitution of a joint venture for the development and operation of the project under discussion. According to the report, at Tepor, the main plan is to handle oil, liquefied natural gas (“LNG”), natural gas liquids (LNG and C5+, which is the liquid portion of the gas), as well as light and dark fuels such as diesel, gasoline and magnesium oxide (MGO).

The plan for this project comprises two terminals (“Terminal A” and “Terminal B”), a natural gas processing unit (“NGPU”), as well as a pipeline network and other facilities. This NGPU will be able to process 60 million m³/day, whose license was already issued by the State Environment Institute (Instituto Estadual do Ambiente – “INEA”) in 2022. Terminal A (for liquid bulk handling, offshore support and floating LNG regasification unit) will be able to regasify up to 21 million m³/day of natural gas, whereas Terminal B (for oil handling) will be able to handle up to 2 million barrels per day (bpd).

ANP establishes specifications for oil currents

On July 18, 2023, SPG-ANP Order No. 764/2023 was published, through which ANP’s Superintendent of Government Participation established the technical specifications for oil currents, effective as of June 2023 production month. These specifications are meant for calculating the Oil Reference Price (ORP), according to Art. 7 of ANP Resolution No. 874, of April 18, 2022.

ANP publishes summaries of new declarations of commercial viability
On July 19, 2023, the ANP began to publish, on its website, the executive summaries of the development areas, originated from the commercial viability declarations (“DCs”) of the exploratory blocks (or some of them). The executive summaries provide information such as maps of the retained areas, contract number, Discovery Assessment Plan (“PAD”), which gave rise to the area, among others.

Investments in the exploration phase can reach BRL 21 billion by 2027

On July 19, 2023, the ANP published data from the 2022 Annual Exploration Report, presented at the seminar 2022 Annual Exploration Report – Diagnosis and Perspectives of Oil and Natural Gas Exploration in Brazil, held by the ANP itself on July 17, 2023.

At the time, data on oil and natural gas exploration in Brazil as well as investment estimates for the coming years were displayed, which are available in the 2022 Annual Exploration Report regarding the 2016-2022 time frame.

According to the ANP, information from the 2023 Exploratory Work Plans (“PTEs”) submitted to the ANP indicate that, only in the exploration phase, investments can reach up to BRL 21 billion by 2027. Of this total, BRL 5.6 billion (29%) correspond to 2023, and BRL 7 billion (34%) to 2024.

ANEEL issues summons to Light SESA

According to a press release published by the Brazilian Electricity Regulatory Agency (“ANEEL”), the ANEEL issued a Summons to Light Serviços de Eletricidade S.A. (“Light SESA”) (distribution concessionaire), for having considered that the Results Plan submitted by the distributor did not contain measures to ensure improvement of the concessionaire’s performance, and also to ensure the recovery of the economic and financial sustainability of the concession.

Light SESA must inform ANEEL whether it will present either a plan for recovering the concessionaire’s economic and financial conditions or a plan for transferring corporate control.

The administrative proceeding, within the scope of ANEEL on the matter, is entitled as: “possibility of applying a penalty of concession expiry”, and was assigned to officer Hélvio Neves Guerra, on July 24, 2023.

Minha Casa, Minha Vida” program provides guidelines on power

On July 13, 2023, Federal Law No. 14,620/2023 was published, which resumes the “Minha Casa, Minha Vida” program, created by the Federal Government, aiming to foster the right to the city and to housing for families residing in urban and rural areas. The law under discussion provided some highlights relating to energy-related activities:

  • The program will subsidize the training of local leaderships for operation and maintenance of photovoltaic systems or other renewable sources.
  • The installation of photovoltaic solar energy and power generation from the distributed generation (“DG”) modalities may be included in the investment amount and costing of the program operation.
  • The consumer unit participating in the Electric Energy Offset System (“SCEE”) may will be able to trade the surplus electricity with public entities, provided that it is a beneficiary of a social or housing program of the federal, state, district or municipal spheres.
  • For the urbanized lots produced under the program, the investment made by the entrepreneur in the energy distribution grid will be converted into a subsidy or tariff discount to the lot owners.

“Debt Waiver Day (Dia do Perdão)” is regulated by ANEEL

On July 13, 2023, ANEEL published Normative Resolution (“REN”) No. 1,065/2023, listing the requirements and procedures relating to the exceptional mechanism for processing generation grants, as well as the Transmission System Use Agreement (“CUST”) entered into by generating plants.

In addition, on July 26, 2023, ANEEL published a guide of frequent answers and questions (“FAQ”) on the matter.

COPEL publishes information on its privatization process

On July 26, 2023, Companhia Paranaense de Energia (“COPEL”) published Material Fact No. 12/23, informing about the request to the Securities and Exchange Commission (“CVM”) for registration of a public offering for primary and secondary distribution of approximately 549 thousand shares, in order to carry out its privatization. The pricing of the offering will occur on August 08, 2023. The Priority and Retail Offering for Shareholders will occur from August 02 to 07, 2023.

On the same date, COPEL published a prospectus on its privatization process, containing information such as:

  • summary of the Offering;
  • existing assets;
  • intended corporate structure after privatization; and
  • financial data about the company, among others.

The privatization process is being coordinated by BTG Pactual (Lead Coordinator), Itaú BBA (Stabilizing Agent), Bradesco BBI, UBS BB and Morgan Stanley.

PPI Council rules on qualification of energy efficiency program in public buildings

On June 30, 2023, the Council of the Investment Partnerships Program (“CPPI”), an advisory body to Brazil’s president, published Resolution No. 277/2023 ruling in favor of the policy qualification aimed at fostering energy efficiency within public buildings owned by federative entities, within the scope of the Investment Partnership Program (“PPI”). The policy aims to carry out studies with private companies in order to structure pilot projects on the matter, and it was submitted for deliberation by the Brazilian president.

ANEEL rectifies provisions of REN No. 1,000/2021 and REN No. 1,059/2023

On July 04, 2023, rectifications of REN No. 1,000/2021, providing for the supply of electricity, and REN No. 1,059/2023, regulating the Legal Framework for Generation Distribution (“Legal Framework for GD”), were published through an amendment to REN No. 1,000/2021.  Although some rectifications are only wording adjustments, other rectifications are significant to accessing users of energy distribution grids.

ANEEL opens Call for Contributions on regulatory sandboxes in the energy sector

On July 03, 2023, ANEEL opened the Call for Contributions (“TS”) No. 009/2023 aiming to obtain contributions on guidelines for experimental regulatory environment programs (“Regulatory Sandbox”) in the energy sector.

According to ANEEL, as the energy network develops into a more decentralized structure, with greater involvement of end users, “it becomes necessary to allow for tests in new regulatory frameworks that can improve support for the integration of smart networks of advanced technologies, business models and others“.

Contributions can be sent until August 18, 2023, directly on ANEEL’s website.

Bill on Infrastructure Debentures approved by the Senate’s Infrastructure Committee

On July 04, 2023, the Senate’s Infrastructure Committee (“CI”) approved Bill No. 2646/2020 (“Bill on Infrastructure Debentures”). The Bill under discussion establishes and regulates a new modality of debentures with tax incentives, aimed at financing investments in infrastructure, which will coexist with the current incentivized debentures.

Ratifying Resolutions on revenues and charges of the electricity sector are published

In July 2023, ANEEL published Ratifying Resolutions (“REH”) that approved the revenues and charges of agents in the electricity sector. Read the REH below:

  • REH No. 3,216/2023, published on July 07, 2023: establishes the Annual Allowed Revenues for the provision of facilities under the responsibility of transmission agents for the 2023-2024 cycle.

Platform providing energy trading data is launched by CCEE

On July 11, 2023, the Electric Energy Trading Chamber (“CCEE”) launched Portal Dados Abertos CCEE (“CCEE Open Data Portal”), which is an important initiative aimed at displaying a range of data relating to the energy trading market in Brazil. Such portal contains, for instance, data on consumption, reconciled consumption, and generation used in the accounting of the Short-Term Market (“MCP”).

ANEEL amends PRORET to adjust tariff calculations

On July 20, 2023, ANEEL published REN No. 1,066/2023, approving Submodule 12.1. of the Tariff Regulation Proceedings (“PRORET”), in order to establish the procedures for the Review of the Annual Generation Revenue (“RAG”) and for the X-Factor of the hydroelectric plants framed under the system of physical guarantee and power quotas. In this landscape, ANEEL’s board of directors set the amount of BRL 9.8 billion for the RAG of hydroelectric plants for the 2023/2024 cycle, and 59 hydroelectric plants were benefited.

MME establishes GT to advise on distribution concessions

On July 21, 2023, the Ministry of Mines and Energy (“MME”) published Ordinance No. 488/2023, establishing the Working Group – Distribution Concessions of the States of Amazonas and Rio de Janeiro (“GT CDAR”), with the purpose of analyzing the sustainability of the public energy distribution service concessions granted to Amazonas Energia S.A., Light Serviços de Eletricidade S.A. and Enel Distribuição Rio. The GT CDAR will carry out weekly meetings to ensure the feasibility of the recommended solutions.

HIGHLIGHTS

EU and Argentina enter into energy agreement

The European Union (“EU”) and Argentina have entered into an agreement on gas, hydrogen and renewable energy sources aimed at increasing Argentina’s LNG exports to Europe, thus contributing to the reduction of gas leaks, as well as developing the production of renewable energy.

The non-binding agreement revolves around four main aspects: hydrogen and its derivatives, renewables, energy efficiency and liquefied natural gas. As a result of the conflict in Eastern Europe and subsequent drop in gas flows in Europe, trading partners have committed to ensuring stable gas delivery.

Such cooperation has been established after failed negotiation attempts towards a trade agreement between both economic blocs, the EU and Mercosur. Therefore, this is a bilateral partnership that, according to the president of the European Commission, Ursula Von der Leyen, will turn the world into a safer, more sustainable and prosperous place.

First offshore wind project announced in Rio de Janeiro

On July 21, 2023, the Rio de Janeiro State Secretariat for Energy and Marine Economy reported that it will be responsible for carrying out the first project to test the feasibility of offshore wind power plant implementations.

The secretariat in question brought together leaders from 20 companies and associations from the oil and gas sectors, as well as from port logistics, power generation and industries in order to discuss the creation of this innovative model in the north of the State.

China switches on the world’s largest wind turbine for the first time

On July 24, 2023, the Chinese company Three Gorges Energy announced they would switch on the world’s largest wind turbine, with a capacity of 16 megawatts (MW). The wind turbine is 152 meter-high and has 123 meter-long blades. The structure has the capacity to withstand wind gusts of almost 290 km/h and provide renewable energy for up to 36,000 Chinese residences.

Located in Fujian’s Offshore Wind Farm, in the Taiwan Strait, the plant is expected to generate energy equivalent to 66 gigawatts-hour (GWh) per year. With this project, China intends to continue expanding its investments in order to build an 18-MW turbine.

Petrobras directs investments in biofuels and H2V

On July 25, 2023, during an event held in São Paulo, Petrobras stated its commitment to allocate from 6% to 15% of its overall investments in low carbon projects. The company also stated that its current focus is on biofuels, whereas green hydrogen (GH2) is considered as a future opportunity.

According to the statement published, the projects will be included in the company’s next strategic plan, with a duration expected from 2024 to 2028.

Applications to discuss the National Hydrogen Program opened

On July 26, 2023, the Ministry of Mines and Energy opened applications for a meeting with the private sector regarding the National Hydrogen Program (“PNH2”). According to this entity, the meeting seeks to encourage an alignment with the sector under discussion on the ongoing measures under the PNH2, including the three-year (2023-2025) work plan. During such occasion, priority measures, which are already underway, will also be released.

The meeting will be held on August 16, 2023, from 2 p.m., at the MME headquarters, in Brasilia. Interested companies can register until 8 p.m. of August 14, 2023.

 

Report about global energy transition is published

On June 28, 2023, the “Fostering Effective Energy Transition 2023” report was published by the World Economic Forum, which displays the global energy transition landscape.

Brazil occupies the fourteenth position among 120 countries analyzed in relation to energy efficiency.

According to the report, Brazil is the largest producer of wind power in Latin America, and is ranked among the 10 largest wind power producers in the world.

Brazilian energy matrix increased 5.1 GW in the first half of 2023

According to ANEEL, in the first half of 2023, Brazil increased 5.1 gigawatts (“GW”) in terms of installed capacity of power generation, representing 49.97% of ANEEL’s target for the year 2023.

Among 160 power plants that started commercial operations in the first half of 2023, 67 of those are wind power plants, 59 are solar photovoltaic plants, 23 are thermoelectric plants, 8 are small hydroelectric plants, and 3 are hydroelectric power plants.

Another significant point is Brazil’s prominence in renewable sources, as it was announced that among the 193.9 GW in operation in the country, 83.55% come from renewable sources.

Pilot project to implement offshore wind farms is being developed in Rio de Janeiro

On July 19, 2023, the State Secretariat of Energy and Economy of the Sea of Rio de Janeiro (Seenemar) gathered entities from the energy, oil and gas sectors, as well as from ports and industries, in order to discuss the construction of offshore wind farms in Rio de Janeiro. The regulatory aspect is still being discussed by the Secretariat’s Working Group.

In addition to its extensive coastline, Rio de Janeiro holds offshore experience in the port and oil and gas industries. These factors should help the State to outline the pilot project to test the feasibility of offshore wind implementation. As a result, in addition to developing the State’s energy transition, it will also take a step towards the production of low-carbon hydrogen.

Ceará invests BRL 16 million in research to leverage renewable projects

On July 07, 2023, an investment was announced with the aim of supplying the Renewable Energy Research Network. The government of Ceará has published Notice 02/2023, and expects to collect up to BRL 16 million in financing by 2026.

The investment was developed by Fundação Cearense de Apoio ao Desenvolvimento Científico e Tecnológico (“FUNCAP”, that is, a foundation aimed at supporting scientific and technological development in the state of Ceará), an entity linked to the Secretariat of Science, Technology and Higher Education of the State of Ceará (“SECITECE”). The public notice provides for an initial investment amount of BRL 4 million, in 2023, and will count on additional BRL 4 million per year, until 2026.

To date, Ceará has entered into 31 memoranda of understanding with domestic and international companies, reaching the mark of more than USD 30 billion (BRL 145.7 billion) invested.

Paraná outlines criteria for the presentation of renewable projects

On July 10, 2023, the government of Paraná published SEFA Resolution No. 649/2023, which establishes criteria for the submission of renewable projects, among them, the amounts and deadlines for granting and transferring investment credits.

Those interested in submitting projects relating to the 2023 financial year must submit an application by September 15, 2023, while those interested in submitting projects relating to the 2024 financial year must submit an application by June 30, 2024. Projects need to meet the following criteria in order to take part in the program:

  • acquire at least 90% of the inputs intended for the construction of suppliers in Paraná; and
  • reinvest 7% of the transfer amounts in social shares, according to the management programs of the state of Paraná, or upon bank deposits in a specific current account of the Paraná Competitive Program.

Green hydrogen will generate more than 5,000 jobs in Ceará

On July 19, 2023, representatives of Fortescue Future Industries (FFI) met with the city government of Caucaia to launch a green hydrogen plant, which is expected to be installed in Export Processing Zone 2 (“ZPE”).

The project, which is in the pre-feasibility phase, is intended for developing environmental and social impact studies to expand the possibilities of sustainable generation of green hydrogen in the region. The protection of the local biodiversity and communities will be projected in the feasibility phase, which precedes the effective construction and beginning of the operation.

The city of Caucaia houses other green hydrogen projects, being an attractive hub for the diffusion of the initiatives of this energy matrix. In addition to the development of renewables, the city government of Caucaia has ensured investment in education and professional training in order to benefit local citizens and ensure greater employability.

Energy transition: Partnership between Petrobras and BNDES in progress

On July 20, 2023, the presidents of Petrobras and the National Bank for Economic and Social Development (“BNDES”) met in order to establish a joint agenda focused on energy transition. The efforts arose as a result of the execution of the Technical Cooperation Agreement, entered into between both institutions, which includes the theme of decarbonization in their practices.

Both Petrobras and BNDES demonstrate that they expect to focus on stimulating the supply chain as a way to foster the national industry.
