Regulation published on accelerated depreciation of tankers in cabotage of oil and its derivatives
On November 08, 2024, Decree No. 12,242/2024 was published, which regulates the accelerated depreciation of tankers used for transporting (known as “cabotage”) oil and its derivatives. As informed by the Ministry of Mines and Energy (“MME”), the measure aims to increase the competitiveness of Brazilian shipyards in international competition, thus encouraging the construction of tankers in the country. The decree seeks to foment local content, reduce dependence on imports, and ensure industrial intelligence and naval engineering in Brazil by facilitating the renewal and maintenance of vessels.
The decree reduces the depreciation period from 20 to 2 years, making projects more attractive and economically viable within the national territory. Accelerated depreciation allows for sectoral companies to lower the costs of purchasing and maintaining tankers faster, making investments in the maritime fleet of this segment more attractive. To be considered eligible for the benefit, interested parties must access the Federal Government’s Portal (Portal Único), in the MME section, where the application form and detailed guidelines for the application are hosted.
91 oil blocks included in open acreage
On November 29, 2024, the MME announced the inclusion of 91 new blocks located in the São Francisco and Potiguar Basins, and in the Pre-Salt polygon, for the Open Acreage System. With this measure, the next auction cycle will potentially raise BRL 2.4 billion in subscription bonuses, considering both sharing and concession systems.
This action integrates the Potencializa E&P program, recently created by the MME, and aims to make the 2025 auctions even more appealing. In the São Francisco Basin, in addition to natural gas, there is great potential for natural hydrogen exploration, thus strengthening the National Hydrogen Program.
The new offering includes 39 areas in the São Francisco Basin, in Minas Gerais, 41 blocks and a marginal accumulation field in the Potiguar Basin, in Rio Grande do Norte, and 11 blocks in the Pre-Salt polygon.

Concession Open Acreage: ANP anticipates publication of updated notice and draft contracts
On December 19, 2024, the Collegiate Board of the Brazilian National Agency for Petroleum, Natural Gas, and Biofuels (“ANP”) approved the updated version of the notice and draft contracts governing the Concession Open Acreage (“OPC”). There are 332 exploratory blocks of a new frontier, 44 located onshore and 288 located offshore, all located in 11 sedimentary basins.
The ANP anticipated the publication of the notice, which allows for the exploratory areas to be made available faster, thus enabling the start of a new OPC cycle in the first half of 2025.
Among the key improvements, we highlight the following:
- Adjustments resulting from the change of local content guidelines established in CNPE Resolution No. 11/202;
- Adjustments resulting from the publication of Resolution No. 969/2024, which regulates bids for exploration, rehabilitation, and production grants of oil and natural gas under the concession open acreage and production sharing regimes;
- Update of guarantee insurance models arising from Public and Public Hearing No. 01/2024;
- Exemption from payment of the participation fee and the data sample;
- More than one bidder can provide a guarantee in consortium bids;
- Bidder can submit a bid guarantee without a declaration of interest, in order to expand the opportunities for forming consortia;
- Fixed minimum subscription bonuses established for blocks in mature and new frontier onshore basins;
- Block extension adjustment due to the implementation of new criteria for selecting areas, considering more comprehensive socio-environmental criteria;
- Adjustments to the regulations and procedures for re-opening the public session;
- Cover letter required for newcomers;
- Adjustments to the conditions so that seismic reprocessing can be converted into work units to comply with the Minimum Exploratory Program (“PEM”);
- Extension of the deadline for submitting the pecuniary update to the ANP based on the General Price Index – Domestic Availability (“IGP-DI”) of the financial guarantees that ensure compliance with PEM and the Initial Work Program (“PTI”);
- Expanded list of companies for which notification to the ANP is waived in order to provide the data acquired from the operations and the contract; and
- Deadline reduction, from 30 to 20 days, for the ANP to appoint an arbitral institution, among those listed in the contract, if the parties do not reach an agreement regarding such institution.

Pre-Salt reaches record production in volume and share in the Brazilian overall figure for September
On November 01, 2024, the ANP published news pointing out that oil and natural gas production from the Pre-Salt for September was the largest ever recorded in terms of volume and share, considering the Brazilian overall figure. In total, 3.681 million barrels of oil equivalent per day (boe/d) were produced – the largest volume ever recorded. The Pre-Salt share in the national production was also the largest ever recorded, having reached 81.2% in total.
Considering all environments, Brazil’s overall oil and gas production reached 4.539 million boe/d. Natural gas production accounted for 169.92 million cubic meters per day (m³/d), which is considered an ultimate record. These figures represent a 6.4% increase compared to August 2024, and a 7.6% increase compared to September 2023. Regarding oil, 3.470 million barrels per day (bbl/d) were produced within the national territory – a rise of 3.9% compared to the previous month, yet a drop of 5.5% compared to the same month in 2023.
The volume of 3.681 million boe/d produced in the Pre-Salt represented an increase of 6.3% compared to the previous month and a 2.4% increase compared to September 2023. According to the ANP, 2.864 million barrels of oil per day (bbl/d) and 129.90 million cubic meters of natural gas per day were produced from 153 wells. The percentage of natural gas used during September was 97.9%. Of this percentage, 56.87 million m³/d were provided to the market, while burning reached 3.63 million m³/d. There was a 0.6% increase in burning compared to the previous month, and an 8.3% increase compared to the same month in 2023.
During September, maritime fields produced 97.6% of oil and 83.6% of natural gas. Either alone or in consortium with other companies, Petrobras’s fields represented 90.54% of the overall amount produced. In total, 6,428 wells were operated in production activities, of which 495 are located offshore and 5,933 are located onshore.
ANP expands monitoring of methanol sales through new dynamic dashboard
On November 07, 2024, the ANP published the new Dynamic Dashboard for Sensitive Products. This interactive tool aims to monitor operations carried out in Brazil involving products considered to be sensitive to the national supply.
Initially, the dashboard is restricted to displaying data regarding methanol – a fundamental product to several economic activities (such as the production of biodiesel, formaldehyde, and medium-density fiberboards) –, which is considered a solvent, in compliance with ANP Resolution No. 937/2023. As informed by the ANP, other solvents and products described as naphtas will gradually be incorporated into the tool.
The tool’s purpose is to increase transparency and allow the market to monitor methanol handling, thus contributing to identifying potential indications of product deviation for irregular purposes (such as fuel adulteration).

Natural gas: POCC 2024 is approved
On November 14, 2024, the ANP approved initiating the offering and contracting processes for natural gas transportation capacity (“POCC 2024”) from 2024 to 2029. Nova Transportadora do Sudeste (NTS), Transportadora Associada de Gás (TAG), Transportadora Brasileira Gasoduto Bolívia-Brasil (TBG), and Transportadora Sulbrasileira de Gás (TSB) will conduct the processes indirectly under the ANP’s supervision.
These processes aim to provide all available firm transportation capacity (including guaranteed handling of the contracted volume) into and out of the carriers’ transportation pipeline network through annual contracts for 2025 to 2029.
In addition, the draft master contract has been approved for all carriers. Interested agents must execute the draft to participate in each process. The master contract includes annexes such as the Transport Capacity Bidding and Contracting Process Regulation and the draft inbound and outbound transportation contracts, which will be executed once the process is finished.
The ANP also approved the short-term product offering schedule for November and December 2024, as provided for in the regulation. Implementing these measures will potentially encourage the entry of new agents, reduce concentration, and increase competition in the natural gas market – in addition to ensuring predictability and stability in natural gas supply.

Records achieved in fuel production and sales for 2024
On November 27, 2024, the MME announced that Brazil reached historical records in the energy sector, standing out in fuel production and sales. From January to October, diesel sales totaled 56.7 billion liters, an increase of 3.7% compared to the same period last year, whereas 6.2 billion liters were sold in October, 7.6% more than in October 2023.
As for production, S-10 diesel registered 24.6 billion liters by October, an increase of 5.9% compared to 2023, with a monthly record of 2.798 billion liters in October. In September, natural gas production reached 169.9 million cubic meters per day, the highest ever recorded in the country.
With a solid performance and promising prospects, Brazil is reaffirming its leading role in the energy market, based on innovation and commitment to a more sustainable future. These figures show the country’s ability to overcome challenges and contribute to the global energy transition.

HIGHLIGHTS
Ordinance defines guidelines for energy auctions in Isolated Systems
On November 22, 2024, the Ministry of Mines and Energy (“MME”) published GM/MME Normative Ordinance No. 92/2024, which defined the guidelines for energy and electric power acquisition auctions and established measures that apply to Guaranteed Energy Supply in Isolated Systems, with the supply starting in 2027.
The supply solution presented in the ordinance involves the generation and storage of energy and the delivery of electric power to the Isolated System. It requires that at least 22% of the energy be generated from renewable sources, with or without storage solutions, and use of equipment and facilities prepared for the humidity and temperature conditions of the Amazon region, among other points.
The public auction session is scheduled for May 2025.

CCEE registers 21,000 new agents by October 2024
On November 14, 2024, the Chamber of Electric Energy Commercialization (CCEE) announced that 21,000 agents had migrated to the association by October 2024.
This can be attributed to the free market opening and an increase in migrations since early 2024.
Most of these migrations correspond to companies in the services sector, followed by the trade, food, and manufacturing sectors. Also, most of the migrations are from the state of São Paulo, followed by Rio Grande do Sul and Rio de Janeiro.

ANEEL rejects CCEE’s new bylaws
ANEEL’s Board of Directors decided not to approve the CCEE’s new bylaws, which had been submitted for approval due to Decree No. 11,835/2023, Decree No. 12,068/2024, and ANEEL Normative Resolution No. 1,087/2024, which modified the CCEE’s structure and operation process.
The following violations were identified in the bylaws:
- Directors’ mandates would last only one year;
- Qualification requirements would be flexible for members of the administrative council, board of directors, and fiscal council;
- Agents whose participation was mandatory could opt out of joining the CCEE if another associated agent served as a representative for accounting and settlement purposes.
As a result, the CCEE must submit another version of the bylaws to correct these issues.

ANEEL approves 2025-2026 regulatory agenda
On November 26, 2024, the National Electric Energy Agency (“ANEEL”) approved its 2025-2026 regulatory agenda, which provides for 28 regulatory activities divided into four themes:
- Generation and Market
- Transmission and Distribution
- Tariff and Financial Regulation
- Energy Efficiency & Consumer
This regulatory instrument makes the regulatory process more transparent, efficient, and foreseeable by listing strategic activities to be regulated by ANEEL in a given period.

ONS creates interactive information platform for access to the National Interconnected System
On November 29, 2024, the National Electric System Operator (“ONS”) launched the “Interactive Guide for Access to the National Interconnected System (SIN),” a platform containing the primary information regarding effective regulation, conditions, and deadlines for users’ access to the transmission system.
The platform provides information on process flowcharts, data for requesting access to the ONS system, deadlines, responsibilities of the parties, contracting, and asset integration.

Fuel of the Future: MME holds debate on developments of ethanol and biodiesel blends
On October 31, 2024, MME held the workshop “Blends Development (E35/B25)”, the first event of the series “Next Steps: Fuel of the Future and the new oil and gas sector policies”. During the event, experts discussed plans for tests demonstrating the technical feasibility of increasing the percentages of both ethanol blended into gasoline and biodiesel blended into diesel. These breakthroughs are essential for the development of public policies focused on sustainability and innovation in Brazil’s energy sector.
The workshop, which included industry representatives, universities, and regulatory agencies, was a milestone in the technical evaluation and reliability criteria for the expanded use of biofuels in Brazil. The proposal to increase the ethanol blend to 35% and the biodiesel to 25% is an innovation introduced by the “Fuel of the Future” law, which President Luiz Inácio Lula da Silva recently sanctioned.

Study shows that the energy sector can attract BRL 3.2 trillion in investments by 2034
On November 07, 2024, the MME, in conjunction with the Energy Research Company (“EPE”), published the 2034 Decennial Energy Expansion Plan (“PDE”). The PDE was based on a study that revealed that the investments planned for the upcoming ten-year period account for approximately BRL 3.2 trillion, divided into three main project categories, with the oil and natural gas industry representing 78% of this total.
According to this document, the Internal Energy Supply (“OIE”) of electricity is expected to grow at an average rate of 2.2% per year, reaching 394.3 million tons of oil equivalent (toe) in 2034. The publication also highlights the increase in electricity availability per inhabitant in Brazil, with the OIE per capita rising from 1.45 toe/inhabitant to 1.72 toe/inhabitant from 2024 to 2034.
Within the context of the Sustainable Development Goal (SDG) 7 – aimed at ensuring clean and accessible energy – it is estimated that, by 2030, the share of renewable energy in the Brazilian national energy matrix will remain at approximately 50% over the projected period. Electricity supply is also tackled, indicating that Brazil’s role will remain predominant in electricity generation from renewable sources – such as hydroelectric, biomass, wind, and solar energy –, thus reaching an average level of 86.1% renewability by the end of the referred ten-year period.
The share of self-production and distributed generation in electricity generation will increase from 15% in 2024 to 17% in 2034, with an emphasis on the shares of biomass (biogas, sugarcane bagasse, bleach, and firewood) and solar energy. The document also introduces the summary of the expansion projected for 2034, and the estimated investments necessary for the energy sector, which is expected to reach BRL 3.2 trillion.

COP29 approves global carbon market regulations
The UN Climate Change Conference (“COP29”), held between November 11 and 22, 2024, in Baku, Azerbaijan, was marked by the approval of rules for creating a global carbon market under the Paris Agreement.
This new mechanism will be managed by the UN and enable the purchase and sale of carbon credits among countries, companies, and other entities.
Creating a global carbon market is a crucial step toward mitigating climate change. This mechanism not only encourages the reduction of carbon emissions but also fosters technological innovation and clean technology transfer between countries.

Federal Court of Accounts creates energy transition audit guide
The Brazilian Federal Court of Accounts (“TCU”) has published a practical audit guide on “energy transition” aimed at supreme audit institutions.
The guide emphasizes the importance of transforming the global energy matrix by replacing fossil fuels with renewable and sustainable sources. It also highlights the need to promote the use of clean energy, improve energy efficiency, and adopt new technologies to manage resources with more intelligence and sustainability.
The guide plays an essential role in advancing international commitments related to climate change. By providing a reliable and adaptable structure for analyzing energy transition, the guide can assist institutions in assessing and monitoring progress toward global targets set out in international agreements.

Resolution updates photovoltaic cell import rate
On November 13, 2024, GECEX Resolution No. 666/2024 was published, which updated the import rate for photovoltaic cells.
Given the rate increase, the measure aims to stimulate the local production of components and inputs, such as cells, wafers and modules, reducing external dependence and increasing added value in Brazil. The resolution also states that certain companies importing photovoltaic modules may remain exempt from this rate through a USD 1,014,790,000 quota by June 2025.

MME must provide action plans to develop public policies aimed at energy transition
On November 27, 2024, the TCU ordered that the MME present, in 180 days, an action plan providing for activities and a schedule of studies on public policies and government actions aimed at energy transition.
The control action analyzed four main aspects of the energy transition policy:
- Development of structures and government management for implementation;
- Alignment of investment needs with existing systems;
- Justice and inclusion values in transition proposals; and
- Maturity of government actions in specific sectors.
The main conclusion was that, despite the government’s efforts and leadership in actions against climate change, there are still plenty of challenges to overcome in order to achieve an effective and integrated energy transition.
The TCU specified that the MME must develop a detailed action plan to review current subsidies granted to the electricity sector. In addition, the MME must establish measurable goals to promote energy justice, ensuring that energy transition benefits are distributed fairly across society.
The audit also highlighted the need to review the energy transition financing strategy. The TCU recommended that the MME adopt measures to mitigate the underutilization of oil income and the imbalance of investments between fossil and renewable energies.

MME authorizes renewable generation investments in Fernando de Noronha
On November 01, 2024, the MME authorized the distributor, Neoenergia, to invest approximately BRL 300 million in renewable energy generation projects in Fernando de Noronha (PE). This ordinance, executed by Minister Alexandre Silveira, establishes that the distributor must increase the island’s energy supply through renewable sources.
As reported, the distributor plans to install solar photovoltaic panels combined with batteries to reduce greenhouse gas emissions by 85% and implement energy efficiency measures. The distributor must submit an investment plan to the Brazilian National Electric Energy Agency (“ANEEL”) within 30 days. The publication also authorizes the immediate energy supply to the island until the new solution is implemented, which is scheduled for 2027.
The new investments will ensure greater energy security, increasing the energy supply to 140 thousand residents and tourists visiting the island annually. This initiative also establishes that such investments will not incur additional consumer costs.
The next step involves the distributor proceeding with environmental licensing with the relevant federal and local agencies.

COP 29: MME launches platform to attract foreign and national investments in energy transition
On November 13, 2024, the MME, in partnership with Brazil’s National Development Bank (“BNDES”) and the Ministries of Finance, Industry and Trade, and Environment, launched Plataforma Brasil for Climate Investments and Ecological Transformation (“BIP”). BIP aims to attract domestic and international investment in solutions for energy transition, industry, mobility, and climate. BIP was launched during the 29th Conference of the Parties to the United Nations Framework Convention on Climate Change (COP29) in Baku, Azerbaijan.
The platform was created to raise national and foreign capital in support of the Brazilian Government’s Ecological Transformation Plan (“PTE”) and Plano Clima, thus reinforcing Brazil’s commitment to carbon-zero emissions by 2050. The platform will provide greater visibility to sustainable projects, in line with the Federal Government’s policies, including initial investments of USD 10.8 billion aimed at benefiting the population.
The projects involving energy transition to be inserted in the platform must be related to the following topics: sustainable fuels, renewable solutions for isolated systems, low-carbon hydrogen, technologies for electricity transmission and distribution networks, offshore wind energy, energy efficiency, and Strategic minerals for energy transition.
