ANEEL opens Call for Contributions on database for second review of transmission concessionaires not tendered

On August 02, 2022, the National Electricity Regulatory Agency (“ANEEL”) published Notice of Call for Contributions No. 041/2022 (“TS No. 14/2022”), which is aimed at obtaining contributions regarding a database to be employed as reference in the benchmarking study[1] on the efficiency of regulatory operational costs of transmission concessionaires whose concessions were extended under Law No. 12,783/2013.
The opening of TS No. 14/2022 was recommended by the Superintendence of Economic Regulation and Market Studies (“SRM”), through Technical Note No. 97/2022. TS No. 14/2022 seeks to discuss and evaluate the consistency of the database to be used in the process of calculating efficiency parameters and defining efficient operational costs, which is provided for in section 5, version 4.0, sub-module 9.1 of the Tariff Regulation Proceedings (“PRORET”). The databases will be referenced for the second periodic review of the Annual Allowed Revenue (“RAP”) from transmission concessionaires whose concessions were renewed under Law No. 12,783/2013[2]. Within the scope of the Call for Contributions, the database containing the data below was made available for public contributions of interested parties:
- Accounting Operating Costs: data were gathered from information provided by the transmission concessionaires in the Standardized Monthly Balance (“BMP”) submitted to ANEEL for the period spanning from 2017 to 2021. The database takes into consideration the expenses on Personnel, Materials, Third Party Services and Others (“PMSO”), and only in sub-accounts similar to those assessed by ANEEL in the benchmarking studies of the distribution sector’s operational costs.
- Physical assets: data gathered on technical features of transmission facilities that initiated commercial operation by June 30, 2021. Data were gathered from the Transmission Management System (“SIGET”), from Confirmatory Resolutions issued by ANEEL (referring to RAP re-adjustment of transmission facilities) and from the Geographic Information Registration System of the National Interconnected System (“SINDAT”). A spreadsheet has been made available so that transmission concessionaires can report inconsistencies in their asset bases – suggesting inclusions, exclusions and changes.
- Groupings resulted from Shared Operations: in order to mitigate inconsistencies in the allocation of costs of transmission facilities of the same economic group, transmission concessionaires that share operational infrastructure, personnel or services were grouped together. The concessionaires provided information regarding the sharing proceedings in response to Circular No. 2/2022-SRM/ANEEL.
- Quality data: gathered from the transmission verification system (“SATRA”), operated by the National Power System Operator (“ONS”), regarding the quality of service provided by transmission concessionaires, considering outages occurred between 2017 and 2021.
- Other information: data regarding the constitution of the concessionaires’ workforce on December 31, 2020, according to spreadsheets submitted by the transmission concessionaires in response to Circular No. 2/2022-SRM/ANEEL.
The deadline of submissions for Call for Contributions No. 014/2022 expires on August 31, 2022. Contributions must be submitted via e-mail to ts014_2022@aneel.gov.br or via Digital Protocol at ANEEL.
