MME announces new program to increase oil and natural gas production in Brazil
On March 24, 2023, the Ministry of Mines and Energy (“MME”) announced that it will launch the Potencializa E&P program, which aims to boost the investments in oil and natural gas exploration and transform Brazil into the fourth largest oil producer in the world.
As informed by the MME, the new project is intended to work on the critical points to develop the exploration in frontier areas and foster investments in mature fields or fields with marginal economicity. In addition, the project aims to foster regional development and support the independent oil and gas producers, whose actions generate an increase in collection, taxes, government equity, jobs, and income.
The expectation is that, by 2029, Brazil increases its current production from 3.0 million barrels per day to 5.4 million barrels per day, becoming the world’s fourth largest producer. According to the MME, 80% of the resources that would generate this increase would be obtained from the production on Pre-Salt Area.
Also, according to the MME, the resumption of licensing for oil and natural gas Exploration & Production (“E&P”) projects would have the potential to generate a state collection of 200 billion dollars.

ANP launches Dynamic Dashboard for Investments Forecast in Exploration Phase
On March 23, 2023, the Brazilian National Agency for Petroleum, Natural Gas and Biofuels (“ANP”) launched the Dynamic Dashboard for Investments Forecast in the Exploration Phase. The new tool presents activity and investment forecasts issued by companies holding E&P Contracts, regarding their Exploration Work Plans (“EWP”).
According to this Dashboard, investments of 1.5 billion dollars are estimated for 2023.

Investments in authorized transportation infrastructure exceed the mark of 1 billion reais
According to the ANP, in a publication made on March 17, 2023, the investments forecast authorized in 2022 in transportation infrastructure is around 1.15 billion reais. In accordance with the 2022 Annual Infrastructure Authorization Newsletter, considering the capital to be invested, 665 million reais will be destined to terminals, 126 million reais to oil pipelines and 341 million reais to gas pipelines.
The Annual Newsletter aims to display the main 2022 authorization acts, investments and increases related to the Brazilian infrastructure for oil, oil products, natural gas and biofuels.

Concession Open Acreage will have three new areas
On March 14, 2023, public hearing No. 05/2023 was held to discuss the inclusion of exploration blocks PRC-T-54 and ES-T-399, as well as the inclusion of an area with marginal accommodation (Japiim) in the Concession Open Acreage (“OPP”).
As a result of the inclusions mentioned above, the Tender Protocol will now comprise 1,098 blocks, in addition to the Japiim area.

CNPE approves, as of April, the increase to 12% of biodiesel blend to diesel
On March 17, 2023, the Brazilian National Council for Energy Policy (“CNPE”) approved, as of April 2023, a resolution that increases to 12% the addition of biodiesel in the composition of the diesel sold in Brazil.
The approved proposal establishes a progressive increase in the biodiesel blended with diesel. In 2023, the blend will exceed the current level of 10% (B10 blend) to reach 12% (B12 blend). In April 2024, the content will be increased to 13% (B13 blend), in April 2025, the content will be increased to 14% (B14 blend) and in April 2026, the content will reach the level of 15% (B15 blend).
The President of Brazil stated that such progressive increases provide safety and predictability to the sector, fosters new job opportunities, investments in the industry, and a reduction in the imports. The effective date for the increased contents to enter into force may be anticipated, based on the CNPE’s evaluation of the supply and demand for biofuels, as well as their impact on the economy.

ANP will hold public consultation and public hearing on draft resolution that unifies bidding procedures for exploration and production of oil and gas
The ANP’s Collegiate Board approved, on March 02, 2023, the public consultation and the public hearing on the draft resolution on bidding procedures for granting of oil and gas exploration, rehabilitation and production activities in concession and production sharing regimes.
The change to the rules proposed by the ANP comprises the Open Acreage system and the bidding rounds. Also, it aims at establishing unified procedures for bidding processes currently regulated by ANP Resolutions No. 24/2013 and 18/2015. The public consultation was opened on March 03, 2023, and will be closed on April 17, 2023. The public hearing is scheduled to occur on April 25, 2023, and will be accessible through Microsoft Teams or the ANP YouTube channel.

ANP proposes to amend ANP Resolution No. 903/2022 to establish mandatory addition of colorant to marine diesel oil
On March 02, 2023, the Collegiate Board of the ANP approved the inclusion of revision of ANP Resolution No. 903/2022 in its Regulatory Agenda in order to establish a new obligation to add colorant to marine diesel oil.
By making this change, the ANP aims to facilitate the differentiation between marine diesel oil and S10 road diesel oil, thus preventing the irregular commercialization of the products. It is worth mentioning that the use of marine diesel oil in automotive vehicles may cause not only engine problems, but also a higher emission of gases resulting from fuel combustion.
The revision of this Resolution has not yet started, so the date for the public consultation and the public hearing still haven’t been estimated.

ANP carries out workshop on access to essential natural gas infrastructure
On March 09 and 10, 2023, the ANP carried out the online workshop on “Access to Essential Natural Gas Infrastructures”. According to the ANP, the purpose of the event was to discuss general aspects of access to essential infrastructure, raised by the Working Group created by the ANP to regulate the topic. The aspects analyzed in the workshop are gathered in the ANP’s Joint Technical Note No. 25/2022.

ANP extends Prior Consultation No. 2/2023 on RIA report, focused on changes in the natural gas specification
As published on March 14, 2023, ANP Prior Consultation No. 2/2023 was extended to May 15, 2023.
The consultation aims to receive technical contributions on the Preliminary Regulatory Impact Analysis Report (“RIA”) arising from the specification of natural gas, thus expanding the social participation in the review of Resolution ANP No. 16/2008, which provides for the specifications and quality controls of natural gas.

Rules for application of PD&I are consolidated in two new ANP Resolutions
On March 14, 2023, the ANP published Resolutions No. 917/2023 and No. 918/2023, which consolidate the rules for application of the Clause of Research, Development and Innovation (“PD&I”).
ANP Resolution No. 917/2023 provides for the accreditation of research units to carry out projects with the capital arising from the PD&I clauses, while ANP Resolution No. 918/2023 regulates compliance with the investment obligation arising from the Clause of Concession and Production Sharing Agreements.
No consultations or public hearings were held for consolidation of these resolutions, as the new normative resolutions only consolidated the rules already present in regulations, without the effective change of object or creation of new obligations.

ANP extends Public Consultation No. 1/2023, on activities related to liquefied natural gas
As published by ANP on March 23, 2023, the Public Consultation on the rules for packaging and transporting liquefied natural gas (“LNG”) in bulk, through methods that serve as an alternative to pipelines, will be extended to May 30, 2023. The ANP intends to update the current regulations in order to increase the reach of natural gas, particularly in regions that do not have a pipeline structure.

ANP includes new item on Transportation Pipelines in its Regulatory Agenda
As provided for in Article 7, item VI, of the New Gas Law, the ANP must regulate the limits of technical characteristics for gas transport pipelines, which led to the inclusion of this topic in its Regulatory Agenda. For establishing the rule under discussion, the ANP intends to prepare, in 2023, the Regulatory Impact Assessment (“RIA”) and the draft resolution, which will be submitted to public consultation.

ANP revises resolution applicable to derivatives manufacturers
The ANP will carry out prior consultation on the technical note aimed at changing the ANP Resolution No. 852/2021, which regulates the production of oil and natural gas derivatives, as well as storage, marketing and service provision of such products.
The ANP also approved the provisional suspension of Article 42 of the abovementioned rule, which provides for authorizations for the assignment of room for storage and transportation of fuels in oil refineries, and approves the insertion of Article 26-A in the Resolution, in order to allow oil derivatives manufacturers to offer storage services for products manufactured within facilities other than those owned by them.
Currently, article 26 allows a manufacturing facility to provide storage services for derivatives, within its tanks, to other agents regulated by the ANP. However, storage is limited to the products manufactured within its own facility.
Until January 01, 2024, article 42 will be suspended and article 26 will have its wording changed with the inclusion of article 26-A. This is the estimated date for completion of the regulatory review. Therefore, damages to the regulated agents will be prevented and the revision process of the regulation will be settled.
At the end of the regulatory revision process, the ANP will establish whether the referred normative changes will be permanent or not.

ANEEL opens Public Consultation on notice for Transmission Auction No. 02/2023
On March 15, 2023, the Brazilian National Electricity Regulatory Agency (“ANEEL”) published Public Consultation Notice No. 008/2023, to obtain contributions on the draft Notice for Transmission Auction No. 02/2023.
This will be the largest transmission auction ever held by ANEEL, which will include 4,471 km² of new transmission lines, 9,840 MVA in transformation capacity and an expected investment of BRL 19.7 billion.
The auctioned lots will encompass the construction of 9 projects, which will be distributed across 5 states – Maranhão, Tocantins, Goiás, São Paulo and Minas Gerais – and will generate approximately 36,000 jobs.
Finally, it is important to highlight that Technical Note 10/2023-SEL/SCT/ANEEL established a condition for the sale of the second lot. The second lot will not be auctioned if there is no interest in the first lot, given that the projects for both lots are related.

ANEEL approves Energy Development Account budget for 2023
On March 13, 2023, ANEEL published ANEEL Ratifying Resolution No. 3,175/2023, which approved the annual Energy Development Account (“CDE”) budget for 2023, in the total amount of BRL 34.99 billion.
The budget includes:
- the Annual Cost Plan (“PAC”) of the Fuel Consumption Account (“CCC”) for 2023, in the amount of BRL 12 billion;
- the Administrative, Financial and Tax Costs (“CAFT”) of the Electric Energy Trading Chamber (“CCEE”) with financial management of sectorial funds, in the amount of BRL 8.892 million;
- the annual CDE-Uso quotas, to be paid by the energy distribution and transmission agents, in the total amount of BRL 28.870 billion; and
- provisions for other uses and funds of CDE, as established in article 13 of Law No. 10,438/2002.

Ministry of Mines and Energy implements the Sector’s Security and Crisis Management Protocol
On March 14, 2023, Normative Ordinance GM/MME No. 61/2023 was published, through which the Ministry of Mines and Energy (“MME”) established the Security and Crisis Management Protocol (“PGC”) for electricity, fuel, and mining facilities.
According to Minister Alexandre Silveira, the Ordinance was published to ensure service supply in Brazil, thus increasing the security of facilities and agility in addressing crises resulting from incidents that compromise the integrity or availability of services.
According to the Ordinance, the Crisis Management Committee (“CGC”) must, within 90 days, submit a specific and detailed protocol that establishes preventive and responsive actions to be adopted in case of imminent or actual situations that jeopardize the integrity or availability of services.

ISA CTEEP launches Brazil’s first large-scale battery energy storage system
On March 23, 2023, the Electric Power Transmission Company of São Paulo (“ISA CTEEP”) launched Brazil’s first large-scale battery energy storage system, pursuant to ANEEL Authorizing Resolution No. 10,892/2021.
Located in the city of Registro, in São Paulo, the project comprises 30 MW of power with the capacity to deliver 60 MWh for up to 2 hours. The storage of energy is aimed at avoiding interruptions in the supply system of approximately 2 million consumers, during peak hours, in the southern coast of the state of São Paulo.
During the project’s inauguration event, ANEEL’s general director, Sandoval Feitosa, stated that the regulation for the use of energy storage will be the subject of two public consultations throughout 2023. The first public consultation is expected to address the regulatory impact analysis and the second is expected to focus on the normative resolution, expected to be approved in 2024.

Bill of the House of Representatives seeks to “consolidate and simplify the interpretation” of provisions of Law No. 14,300/2022 – Legal Framework for Distributed Generation
On March 21, 2023, federal representative Lafayette de Andrada proposed Bill No. 1,292/2023 to amend provisions of Law No. 14,300/2022, which established the Legal Framework for Distributed Microgeneration and Minigeneration and the Electricity Compensation System (“SCEE”).
The representative’s proposal addresses the following aspects of Law No. 14,300/2022:
(i) dismissal of solar energy projects by concessionaires;
(ii) vested rights of consumers who opted for the Group B tariff;
(iii) reallocation of credits and surplus;
(iv) charges of availability costs; and
(vi) charges of the Tariff on the Usage of Distribution Systems to generating plants (“TUSDg”).

Partial results of the Auction for Capacity Reserve Auction in the form of Energy ratified
On March 07, 2023, ANEEL ratified the partial results of Auction No. 08/2022, a Capacity Reserve Auction in the form of Energy (“LRCE”). The purpose of this auction is to contract reserve energy for new generation projects for a period of 15 years, for natural gas thermoelectric sources. Initial supply is scheduled for December 31, 2026.
Among three products offered in the auction, only the North Region project, related to the contracting of up to 1,000 MW, received bids. Products from the Northeast Maranhão and Northeast Piauí regions, related to the contracting of 300 MW and 700 MW, respectively, did not receive any bids.

Neoenergia launches renewable complex in Paraiba
The Renewable Complex Neoenergia – Chafariz Wind Farm (Complexo Renovável Neoenergia – Parque Eólico Chafariz) is a project led by Neoenergia, in which both wind and solar energies will be combined. The farms are connected to the National Interconnected System (“NIS”) through the Neoenergia Santa Luzia II substation, and its production is expected to supply electricity to 1.3 million homes per year.
The project was approved by the Brazilian National Electricity Regulatory Agency (“ANEEL”) in the second half of 2022, and became a pioneering model due to the generation of energy by hybridization of sources, as well as for promoting a relatively new legislative development in Brazil. In addition to this, the development of a project with two energy sources optimizes the entire production chain, as it results in cost reduction and makes the production management more dynamic.
The successful investment in the renewable matrix by Neoenergia ensured solid results. The company achieved an annual profit of 314 million, an increase of 1,156% as compared to the previous year. As a consequence, it has also fostered an increase in the production of renewable energy across the society. In addition, when the energy starts to be used for supply, the process will result in the mitigation of CO2 release, which reaffirms Neoenergia’s commitment to the ESG regulations.
The inauguration of the facility was attended by government authorities and company executives.

Brazil is third in the world ranking of renewable energy
The International Renewable Energy Agency (“IRENA”) released a survey that ranked Brazil as the third largest generator of renewable energy in the world.
The survey considered solar, wind, hydro, tidal, geothermal, biogas, and biofuel energy as sources. According to this study, Brazil has an installed capacity of clean energy of 175 GW. This means that only the United States, with 351 GW, and China, with 1.1 TW, are ahead of Brazil.

Brazil surpasses the 190 GW mark in installed capacity for electricity generation
During the first two months of 2023, the installed capacity for electricity generation in Brazil reportedly increased by 2.04 GW, of which 1.14 GW represented electricity generation from wind sources. Currently, the installed capacity in Brazil exceeds 190 GW.
The Brazilian energy matrix is composed of approximately 57.4% hydroelectric plants, 24.1% thermoelectric plants, 13.1% wind plants, 4.35% solar energy, and 1.05% nuclear energy.
Brazil is ranked among the 10 largest solar energy producers in the world
According to a survey carried out by the Brazilian Association of Photovoltaic Solar Energy (“ABSOLAR”), based on data from the International Renewable Energy Agency (“IRENA”), Brazil ranked 8th among countries with 24 GW of power generation from solar sources by the end of 2022.
The power of solar energy generation takes into consideration 18 GW of distributed generation from solar sources and 8 GW of solar energy from centralized generation (large plants).
In 2021, Brazil occupied the 13th position in this ranking and climbed 5 positions in 2022, due to an increase of 10GW in solar energy generation power and investments of more than BRL 45.7 billion. This represents a 64% increase, compared to the investment carried out in 2021.

MME indicates advance in 2022 of renewable energies in the energy matrix
On March 14, 2023, the MME published the December 2022 Monthly Energy Newsletter. Among the data collected, the increase in photovoltaic solar energy obtained a 78% growth as compared to the previous year.
Hydraulic and wind energy increased by 16% and 12%, respectively, in relation to the previous year’s electricity generation. The Newsletter also indicated a decrease in thermal generation of coal and natural gas, with a reduction of 50% in both.
The advance of renewable energies use in Brazil’s energy matrix is thus evidenced.

ISA Cteep launches first large-scale energy storage project in Brazil
On March 23, 2023, ISA CTEEP, Brazil’s energy transmission company, launched a pioneering large-scale battery energy project. The substation, located in São Paulo, will be responsible for supplying electricity to the southern coast of the state, meeting the needs of about 2 million people.
The system, designed to operate during peak times, is installed in an area that is equivalent to half of a soccer field, and on December 31, 2022, it carried out its first discharge, in order to avoid an interruption in the supply system.
The storage still poses challenges to the supply system because it cannot be activated at any time. This is because storage is not dispatchable, in comparison with the hydroelectric or thermal power plants, but is an alternative to diesel generators, which are much more polluting.
The replacement of diesel generators by batteries should prevent, within a timeframe of two years, the emission of more than a ton of greenhouse gases.
